Kay County Board Meeting Minutes

The Board of County Commissioners (BOCC) of Kay County, Oklahoma, met in regular session at 9:00 o’clock a.m. on Monday, August 1, 2016, in the Commissioners Court of the Kay County Courthouse in Newkirk, Oklahoma. Notice of the meeting was posted for public information on July 29, 2016, at 8:50 a.m. at the Courthouse front door, Commissioners Court, and basement handicapped entrance of the Kay County Courthouse in Newkirk, Oklahoma.

Member Jason Shanks called the meeting to order. Those present were as follows: Paul Skidmore, Member; Brian Hermanson, District Attorney (DA); Christy Kennedy, Kay County Treasurer; Everette Van Hoesen, Kay County Sheriff; Don Jones and Harold Hughs, Kay County Detention Center (KCDC); Susan Keen, Kay County Assessor; Dennis Bonewell, Emergency Management; David Cummings, Attorney for Kay County Public Buildings Authority; Ben Lundquist Claude Williams, Taxpayers for Transparency; Scott Cloud, Newkirk Herald Journal; Sharon Rowen, Ponca City News; Tammy Reese, Secretary/Kay County Clerk. (See sign in sheet).  Absent: Chairman Vance Johnson

Member Shanks led the Flag Salute.

No action was taken to approve/disapprove the minutes of the previous meeting.

Jail Director Report: Don Jones, KCDCD, presented a report noting 293 as the current head count, 60 arrested and released over the weekend and 120 for the week, arrested and released from August 1, 2016-5, daily average of 291, minimum amount of inmates-291, maximum amount of inmates-293, high for 24 hour period for August 1, 2016-295, eight (8) inmates sentenced to county time, 57 inmates sentenced to Department of Corrections (DOC)/(waiting to go to prison). The report showed six (6) weekenders and sanctions, 33 paid contracts with BIA and Bridgeway currently are holding two (2) inmates on writs (prison to court). Jones also presented a Comparison report for the month of July for 2015 and 2016.

Motion was made by Skidmore and seconded by Shanks approving Detention Services Agreement by and between ROCMND Area Youth Services, Inc. and the BOCC of Kay County, $25.00 a day per child. DA Hermanson said the contract was fine. Motion carried: Shanks, aye; Skidmore, aye.

Motion was made by Skidmore and seconded by Shanks approving to enter into an Executive Session pursuant to and convened under authority of 25 O.S. Section 307.B.3, to discuss purchase of site for future location of Dist#3 warehouse (9:06 a.m.). Motion carried: Shanks, aye; Skidmore, aye.

Motion was made by Skidmore and seconded by Shanks approving to reenter the regular meeting of the BOCC (9:24 a.m.). Motion carried: Shanks, aye; Skidmore, aye.

Motion was made by Shanks and seconded by Skidmore approving and authorizing the Chairman to sign the Contract with Halliburton Energy Services, Inc. regarding the purchase of real property located at 319 N. 29th Street, Blackwell, OK.   Motion carried: Shanks, aye; Skidmore, aye.

Motion was made by Shanks and seconded by Skidmore approving to enter into a Kay County Public Buildings Authority (PBA) special meeting (9:25 a.m.).   Motion carried: Shanks, aye; Skidmore, aye.

Motion was made by Shanks and seconded by Skidmore approving to reenter the regular meeting of the BOCC (9:38 a.m.).   Motion carried: Shanks, aye; Skidmore, aye.

Motion was made by Skidmore and seconded by Shanks Tabling (to gather more information) Contract for Supervision of Community Service for FY2016-17. Motion carried: Shanks, aye; Skidmore, aye.

Motion was made by Skidmore and seconded by Shanks approving Reimbursement for Kay County Election Board Secretary Salary for the month of July 2016. Motion carried: Shanks, aye; Skidmore, aye.

Motion was made by Shanks and seconded by Skidmore approving Oklahoma State University (OSU) Services Agreement between Kay County and OSU through its Center for Local Government Technology. Whereas, OSU has developed expertise and related technologies, equipment, practices or facilities thereinafter referred to as “Services” in the area of computer software programs, file server and workstation support, technical support and maintenance, data management, file server and backup support (remote & onsite), report generation and support and training to County Assessors. Assessor Susan Keen said these services were paid for by the state but because of budget short fall the state was no longer paying. Keen said she would make the $2,500 payment in full. Motion carried: Shanks, aye; Skidmore, aye.

Motion was made by Skidmore and seconded by Shanks approving “Amended” Resolution No. 16, 17-9, County Sales Tax/Justice Facilities Authority (JFA) Transactions being deposited into the Kay County Detention Center Fund. Motion carried: Shanks, aye; Skidmore, aye.

Motion was made by Shanks and seconded by Skidmore approving Resolution No. 16, 17-28 depositing all BIA Incarceration Fees into the Kay County Detention Center Fund. Motion carried: Shanks, aye; Skidmore, aye.

Motion was made by Shanks and seconded by Skidmore Tabling quotes obtained for a new roof on the Emergency Management building. Commissioner Shanks said he is still waiting on one quote. Motion carried: Shanks, aye; Skidmore, aye.

Road and Bridge Projects/Circuit Engineering District (CED) No.8 Road and Bridge Projects:

Commissioner Skidmore stated crews continue to dig and screen shale and haul rock to roads, graders laying shale and grading roads and work continues on FEMA projects. Crews are mowing, repairing signs, cleaning intersections and picking up cap rock on the roads and ditches around the Tonkawa area. Skidmore said work continues on 13th Street rebuilding the road around the river on Brake Road. He stated crews have finished laying shale on all the FEMA roads and are now laying top rock. On rainy days crews service trucks, clean in the shop and trim trees. No environmental crew was here last week.

Commissioner Shanks noted his crews have been mowing and boom mowing. He said he had two blades out pulling Ranch Drive by Ferguson and Tower Rd. Shanks said crews should finish up with the rock by the end of the week on Tower Rd and then will pull ditches and then start another project.

Motion was made by Shanks and seconded by Skidmore approving to go out for bid to sell 2012 Ford F150, Sheriff Department. Shanks asked Sheriff Van Hoesen about the truck. Motion was then made by Shanks and seconded by Skidmore to rescind original motion. Motion carried: Shanks, aye; Skidmore, aye.

Motion was made by Shanks and seconded by Skidmore to Table going out for bid to sell 2012 Ford F150, Sheriff Department. Motion carried: Shanks, aye; Skidmore, aye.

Motion was made by Shanks and seconded by Skidmore approving State of Oklahoma Department of Transportation Supplemental and Modification Agreement No. 1 County Improvements for Roads and Bridges Project Agreement, to Resurface on EW-18 (Hubbard Rd), beginning at I-35 and extending 3.5 miles east to US-177. Motion carried: Shanks, aye; Skidmore, aye.

Motion was made by Shanks and seconded by Skidmore Tabling Resolution#72-2016 Approving Interlocal Cooperative Agreement with Contiguous Counties (Kay County Res#16, 17-27). DA Hermanson said he spoke with the Assistant District Attorney (ADA) from Grant County and noted the ADA was going to speak with her commissioners and then would report back to Hermanson. Motion carried: Shanks, aye; Skidmore, aye.

Motion was made by Shanks and seconded by Skidmore approving Cooperative Agreement by and between the BOCC and the U.S. Bureau of Indian Affairs (BIA), Washunga Bay Resurfacing Project, Dist#1 and Dist#2. Shanks said this project would start at Highway 11 and go to Washunga Bay to River Rd. and the west to Newkirk to put in an overlay. Motion carried: Shanks, aye; Skidmore, aye.

Motion was made by Shanks and seconded by Skidmore to Table request for proposal for Bridge Hydraulic Engineer to review existing hydraulics, proposed scour counter measure and provide visual aide for stock holders for Kay County JB#29354-04 Hubbard Road at Chikaskia River overflow, to be paid by CIRB Funds. Motion carried: Shanks, aye; Skidmore, aye.

Motion was made by Skidmore and seconded by Shanks approving Public Service/Pipeline Crossing Line Installation K Power Net, LLC NE4/NE4 S14 T27N R1E ending NE4 S10 T27N R1E, N “U” Str and W. Brake Rd., Dist#3. Motion carried: Shanks, aye; Skidmore, aye.

Motion was made by Shanks and seconded by Skidmore approving the following Resolutions to Dispose of Equipment: Res#16, 17-31, Sheriff Department, 2012 Ford F150, to be sold. Motion carried: Shanks, aye; Skidmore, aye.

Motion was made by Skidmore and seconded by Shanks approving the following Resolutions to deposit: Res#16, 17-29, Child Abuse Prevention-$195.01, jury donations; Res#16, 17-30, Highway Dist#3-$363.25, sale of scrap metals. Motion carried: Shanks, aye; Skidmore, aye.

New Business [As per 1991 O.S. 25§311.A.9-‘New Business’, as used herein, shall mean any matter not known about or which could not have been reasonably foreseen prior to the time of posting. None.
